ENGINE WARRANTY TERMS & CONDITIONS
Cruiser Spares Pty Ltd

Email: info@cruiserutesandparts.com.au

Please read these warranty terms before installing or using the engine. These terms are supplied with the engine.
1. Warranty Period
The following voluntary warranty periods apply from the invoice date:
• Second-hand engine: 1 month
• Rebuilt engine: 3 months
• Reconditioned engine: 6 months
Unless otherwise stated on the invoice, the warranty on a second-hand engine is a parts-only warranty.
This voluntary warranty is in addition to any rights or remedies that may apply under the Australian Consumer Law.
2. Warranty Remedy
Where a valid warranty claim is accepted, Cruiser Spares Pty Ltd will determine the appropriate repair procedure having regard to
the nature of the fault and whether the engine supplied was second-hand, rebuilt or reconditioned.
Where appropriate, replacement parts may include serviceable used, recycled, rebuilt or reconditioned components, particularly
where the original engine supplied was second-hand, rebuilt or reconditioned.
Nothing in these warranty terms limits any remedy that cannot lawfully be excluded under the Australian Consumer Law.
3. Unauthorised Dismantling or Repairs
The engine must not be dismantled, opened, altered or repaired without the prior written consent of Cruiser Spares Pty Ltd.
This includes removal of the sump, cylinder head or other major engine components.
Damage or additional failure caused or contributed to by unauthorised dismantling, alteration or repair will not be covered by this
voluntary warranty.
Where reasonably required to assess a claim, Cruiser Spares Pty Ltd must be given an opportunity to inspect the engine before
repairs are undertaken.
4. Repair Authorisation
Prior written authorisation from Cruiser Spares Pty Ltd must be obtained before warranty repairs are commenced.
Where an approved repair is to be carried out by another repairer, Cruiser Spares Pty Ltd must approve the proposed repair and
costs before work commences.
For second-hand engines supplied with a parts-only warranty, Cruiser Spares Pty Ltd will supply approved replacement parts
where applicable but does not provide a separate voluntary warranty for labour costs.
Where reasonably required, a rebuilt or reconditioned engine may need to be returned to Cruiser Spares Pty Ltd or its nominated
repairer for inspection or repair.
This clause does not exclude any rights or remedies available under the Australian Consumer Law.
5. Engine Configuration and Accessories
Unless otherwise specifically stated on the invoice, engines are sold as bare long engines.
Accessories or ancillary components supplied or left attached to an engine – including manifolds, sumps, alternators, starter motors,
air-conditioning components and similar items – are not guaranteed to be correct for the purchaser’s particular vehicle unless
specifically stated on the invoice.
The purchaser and installer must inspect these components before installation and transfer the correct components from the
original engine where necessary.
Turbochargers are not included in this voluntary warranty unless specifically stated otherwise on the invoice.
Injector pumps supplied or left fitted to an engine are not covered by this voluntary warranty unless the injector pump has
been supplied as a reconditioned unit by Cruiser Spares Pty Ltd.
6. Oil Leaks – Second-Hand Engines
Second-hand engines are used components and may show normal signs of age and previous use.
Minor oil seepage or minor oil leaks consistent with the age and condition of a second-hand engine are not covered by
this voluntary warranty.
Front and rear crankshaft seals on second-hand engines are considered service items and must be replaced before installation.
This exclusion does not apply to a substantial oil leak resulting from a defect that would otherwise constitute a failure to comply with
an applicable consumer guarantee under the Australian Consumer Law.
7. Freight, Removal and Installation Costs
The voluntary warranty provided by Cruiser Spares Pty Ltd does not automatically include freight, towing, vehicle recovery, engine
removal, refitting or installation costs.
Where Cruiser Spares Pty Ltd supplied the engine only and did not install it, our voluntary warranty does not include
labour costs for removal of the engine, installation or refitting of the repaired or replacement engine.
Where the Australian Consumer Law requires Cruiser Spares Pty Ltd to bear or reimburse reasonable costs associated with a
failure to comply with a consumer guarantee, those statutory rights are not excluded by this clause.
No external labour, freight, towing, removal, refitting or installation costs are to be incurred on behalf of Cruiser Spares Pty Ltd
without our prior written approval, unless circumstances make obtaining prior approval unreasonable.
8. Warranty Exclusions
a) insufficient oil, incorrect oil, contaminated oil, incorrect lubricants or failure to maintain the correct oil level;
b) overheating, including overheating caused by a defective or unsuitable radiator, thermostat, radiator cap, water pump, cooling
fan, hoses or other cooling-system component;
c) removal, alteration, damage or absence of an engine heat tab where a heat tab has been fitted;
d) misuse, overloading, racing, competitive events, extreme off-road use, accidents, negligence or operation outside the intended
design limitations of the engine;
e) failure to carry out proper servicing or maintenance;
f) incorrect installation or installation by a person who is not suitably qualified and competent;
g) continued operation after symptoms of a fault, overheating or malfunction became apparent;
h) modifications or increases in engine power or boost outside the engine’s intended specification, unless the application was
disclosed to and approved by Cruiser Spares Pty Ltd before sale;
i) failure to replace the water pump or fuel injectors as required under the installation requirements below, where that failure caused
or contributed to the engine failure.
9. Installation Requirements
To protect the voluntary warranty, the installer must ensure the following are carried out before or during installation:
a) replace the thermostat with a new thermostat;
b) where the engine uses a timing belt, replace the timing belt before installation, unless Cruiser Spares Pty Ltd confirms that it
has already been replaced as part of the rebuild or reconditioning process;
c) replace the water pump with a new water pump on all engines;
d) replace all fuel injectors with new or professionally reconditioned injectors on all engines;
e) professionally inspect, service or replace the radiator as necessary and fit a suitable radiator cap;
f) inspect and, where necessary, replace radiator hoses, hose clamps and cooling-system connections;
g) on second-hand engines, replace the front and rear crankshaft oil seals;
h) replace the engine oil filter, fuel filter and air filter;
i) fill the engine with the correct grade and quantity of engine oil before starting;
j) check that the sump drain plug is fitted and correctly tightened;
k) correctly fill and bleed the cooling system and verify correct operating temperature before the vehicle is placed into normal
service.
Failure to carry out an applicable installation requirement may affect this voluntary warranty where that failure caused or contributed
to the engine failure.
10. Duty to Minimise Further Damage
At the first indication of abnormal noise, overheating, oil-pressure warning, coolant loss, oil loss, smoke or other possible
malfunction, the customer must cease operation as soon as it is reasonably safe to do so and contact Cruiser Spares Pty Ltd.
Damage caused or substantially increased by continued operation after a fault or warning became apparent may be excluded from
this voluntary warranty.
11. Auxiliary and Ancillary Components
This voluntary engine warranty does not provide separate cover for damage to auxiliary or ancillary components merely because an
engine failure has occurred.
However, nothing in this clause excludes or limits any entitlement to compensation for reasonably foreseeable loss or damage that
a customer is entitled to recover under the Australian Consumer Law.
12. Consequential Loss
To the maximum extent permitted by law, this voluntary warranty does not provide additional cover for loss of income, loss of profit,
vehicle downtime, demurrage or other indirect or consequential loss.
Nothing in these terms excludes or limits any entitlement to compensation for reasonably foreseeable loss or damage that the
customer is entitled to recover under the Australian Consumer Law.
13. Statements and Representations
The voluntary warranty provided by Cruiser Spares Pty Ltd is governed by these written terms together with any written
specifications or representations appearing on the invoice or other sales documentation.
Nothing in this clause excludes liability for any representation, warranty, consumer guarantee or other obligation that cannot
lawfully be excluded.
14. Making a Warranty Claim
A purchaser making a warranty claim must contact Cruiser Spares Pty Ltd as soon as reasonably possible after becoming aware of
the fault.
The purchaser may be required to provide:
• invoice number and purchase details;
• vehicle make, model and details;
• engine type and engine number where applicable;
• kilometres travelled since installation;
• description of the fault and circumstances in which it occurred;
• details of the installer;
• details of the engine oil and coolant used;
• servicing and maintenance information;
• evidence that the water pump and injectors were replaced at installation;
• photographs or video of the engine and failure;
• photographs showing the heat tab where fitted;
• diagnostic or repairer reports where reasonably required; and
• access to the engine for inspection where reasonably required.
